These Terms of Service apply to purchases made through the Aguamarinaconstrucciones website and to use of the website.
Acceptance of terms
By placing an order through the website, the customer agrees to these Terms of Service and the policies referenced in them.
Mandatory consumer rights under Spanish and European Union law are not limited by these Terms.
Products and product information
Aguamarinaconstrucciones makes reasonable efforts to present product descriptions, images, dimensions, prices, and availability clearly.
For furniture products, minor variations in colour, texture, grain, finish, or dimensions may occur due to materials, screen settings, manufacturing tolerances, or product characteristics. Such variations do not affect statutory rights where a product is not as described or is not in conformity with the contract.
Prices
Product prices are shown in euros (€) and include applicable VAT unless clearly stated otherwise. Shipping costs, if any, are shown before the customer confirms the order.
Orders
After placing an order, the customer may receive an order confirmation by email. Order processing remains subject to payment confirmation, stock availability, address verification, fraud-prevention checks, and delivery availability.
Aguamarinaconstrucciones may refuse or cancel an order where there is a legitimate reason, including suspected fraud, payment issues, stock unavailability, pricing or product-information error, incorrect customer information, or delivery impossibility.
If payment has already been collected for an order that is cancelled or cannot be fulfilled, the amount paid for the cancelled or unavailable item will be refunded.
Shipping
Shipping terms, delivery areas, estimated delivery times, delivery limitations, and shipping costs are described in the Shipping & Delivery Policy.
Cancellations
Before shipment, customers may request cancellation by contacting Aguamarinaconstrucciones as soon as possible. Cancellation before shipment is not guaranteed because orders may be processed quickly.
After shipment, cancellation may not be possible. Customers may still use the legal right of withdrawal or the commercial return policy where applicable.
Returns and refunds
Returns, refunds, legal withdrawal rights, and quality-related returns are governed by the Returns & Refund Policy.
Legal guarantee and non-conforming goods
Products sold to consumers are covered by the legal guarantee for consumer goods under applicable Spanish law.
The legal guarantee covers lack of conformity under the conditions required by law. It does not cover damage caused by misuse, accidents, improper assembly by the customer, failure to follow care instructions, unauthorized modifications, or normal wear and tear.
Customer responsibilities
Customers are responsible for providing accurate order, payment, delivery, and contact information.
Customers should check product dimensions and make sure that the item can be delivered through the available access points at the delivery address.
Website use
Customers must not misuse the website, interfere with its operation, attempt unauthorized access, or use the website for unlawful purposes.
Limitation of liability
To the extent permitted by applicable law, Aguamarinaconstrucciones is not responsible for indirect losses or consequences caused by circumstances outside its reasonable control. Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
Governing law and disputes
These Terms are governed by Spanish law. If the customer is a consumer, disputes may be brought before the courts of the consumer’s place of residence or any other court permitted by mandatory consumer-protection law.
Updates to these Terms
These Terms may be updated from time to time. The version applicable to an order is the version available when the order is placed, unless a mandatory legal update requires otherwise.
